Non-Compete Agreement

Daycare is a competitive business and the essence of the business is your client base. Security and confidentialty of your client list should be an ongoing effort to prevent dissemination or loss of those resources - your enrolled children.  Along these lines, it is recommended you institute a "non-compete" contract for all employees. We know of one instance, where a daycare employee quit, and setup her own in home daycare, based on six children (a direct income loss of approximately $18,000 for the affected daycare) she supervised while employed. Those persons not wishing to sign such a document may represent a competitive threat in the future. It is essential all current and NEW employees sign such a document as a condition of continued or prospective employment.
